Terms and conditions
1 Scope
These terms apply to contracts for the rental of apartments for accommodation concluded between Alp Ami Hospitality GmbH (ALPAMI) and third parties (the guest), as well as to all further services and deliveries provided by Alp Ami Hospitality GmbH. Only these terms apply. Differing, conflicting or supplementary terms of the guest do not become part of the contract, even if ALPAMI does not expressly object to them.
2 Interpretation
"ALPAMI" means Alp Ami Hospitality GmbH. "Arrival day" is the day on which the booking period begins, as selected by the guest during booking. "Departure day" is the day on which the booking period ends, as selected by the guest during booking. "Room" means a residential unit rented out by ALPAMI. This may be an apartment, tiny house or cabin. "Check-in" is the provision of the digital registration forms. "Booking ID" is the reservation number (an alphanumeric code) by which a booking can be uniquely identified.
3 Rental contract
3.1 Conclusion of contract The accommodation contract is concluded when ALPAMI confirms the guest's booking. ALPAMI accepts by issuing a booking confirmation in text form, or at the latest by providing the room. Offers by ALPAMI regarding available rooms are subject to change and non-binding. ALPAMI reserves the right to refuse to conclude an accommodation contract at its own discretion and without giving reasons. 3.2 Contracting parties The contracting parties are ALPAMI and the guest. If a third party books on the guest's behalf, that party is jointly and severally liable to ALPAMI together with the guest for all obligations arising from the contract, and becomes a contracting party. Using the room for purposes other than accommodation is not permitted. The room may only be used by the contractually agreed number of guests. If further persons not covered by the contract stay overnight, this constitutes a breach entitling ALPAMI to charge an additional fee of at least €50.00 per person per night and/or to cancel the booking without notice. Subletting or passing on booked rooms is prohibited. Assigning or selling the claim against ALPAMI is not permitted. In such cases ALPAMI is entitled to cancel the booking and to claim a contractual penalty of €500.00. 3.3 Limitation period Claims against ALPAMI generally become time-barred one year after the statutory limitation period begins. This does not apply to claims for damages or to other claims based on an intentional or grossly negligent breach of duty by ALPAMI. Claims by ALPAMI against the guest, in particular for damages, cleaning costs or compensation for use, are subject to the statutory limitation periods. ALPAMI is entitled to collect such claims from the payment method on file without prior notice.
4 Services and payment
4.1 Services ALPAMI is obliged to keep available the rooms booked by the guest, or equivalent alternatives, and to provide the agreed services. The guest is obliged to pay ALPAMI the applicable or agreed prices for the room and for any additional services used. All services beyond the booked scope are charged separately. 4.2 Prices The prices shown by ALPAMI at the time the contract is concluded apply. These are gross total prices and include all statutory taxes, fees and charges. Local charges owed by the guest under municipal law — such as visitor's tax — are not included and may be charged separately. If the applicable VAT rate increases or decreases after the contract is concluded, prices are adjusted accordingly. If more than six months pass between conclusion and performance of the contract and ALPAMI's general price for such services increases, ALPAMI is entitled to adjust the agreed price reasonably, but by no more than 15%. Prices may also be changed if the guest subsequently requests changes to the number of rooms, the services provided or the length of stay, and ALPAMI agrees. Changes require text form. Special requests outside the contract are always non-binding. The guest has no claim that ALPAMI will fulfil them unless ALPAMI has expressly confirmed them in text form.
5 Customer data
To ensure communication with the guest, ALPAMI requires the email address, telephone number and the correct first and last name of the main guest. To verify the guest's identity, ALPAMI is entitled to request a valid identification document at check-in (a national identity card or passport for domestic guests; a passport for foreign guests) as well as valid credit card details. If a guest's identity cannot be established beyond doubt because documents are missing or incorrect, ALPAMI is entitled to cancel the booking without the guest acquiring any claim to a refund of payments already made. The guest further authorises ALPAMI to send messages about their booking via their preferred channel, including channels such as WhatsApp and SMS. Should a further pandemic occur, ALPAMI is permitted to comply with the pandemic rules applicable at the place of performance. ALPAMI is entitled to request corresponding evidence from the guest (proof of vaccination, a negative test result or proof of recovery). If requested evidence is not presented, ALPAMI is entitled to cancel the booking.
6 House rules
The house rules contain provisions on the following points: Smoking · Pets · Parties or events · Excessive soiling · Accommodating persons not included in the booking · Excessive noise · Illegal substances · Alterations to the room · Commercial photography, film or video · Use for other purposes · Theft · Communication · Damage · Check-in and check-out A description and any fees incurred for breaching individual points are set out explicitly in the house rules. A breach of the house rules constitutes a breach of duty entitling ALPAMI to impose an immediate ban from the premises and to terminate the accommodation contract without notice. Any fees incurred and claims for damages remain unaffected. The current version is available at any time via ALPAMI's website.
7 Provision and return
7.1 Provision The guest acquires no claim to the provision of particular rooms. Booked rooms are available to the guest from 15:00 on the agreed day of arrival. Where there are compelling operational reasons, ALPAMI is entitled to provide an equivalent replacement room. 7.2 Return On the agreed day of departure the room must be vacated and made available to ALPAMI by 11:00 at the latest. For any use beyond that which has not been approved or agreed, ALPAMI may claim compensation for use (the price of the following night for the same room type at the time of the breach) as follows: – Check-out by 12:00: 25% of the price of the following night – Check-out by 14:00: 50% of the price of the following night – Check-out by 16:00: 75% of the price of the following night – Check-out by 18:00: 100% of the price of the following night – Check-out after 18:00: 150% of the price of the following night plus a handling fee of €50.00 The room must be returned in the condition in which the guest found it. The guest must remove all personal belongings from the room and dispose of food brought in as well as excessive waste. In the event of a breach, ALPAMI is entitled to charge the guest an increased cleaning flat rate based on the extent of the damage plus a handling fee of at least €50.00. These costs are collected from the payment method on file without separate notice. ALPAMI's rooms may be booked for a maximum continuous period of 182 days. If whole bottles of the bathroom amenities have been removed without ALPAMI's consent, ALPAMI is entitled to charge an additional fee of €50.00 and to debit it from the guest's payment method.
8 Cancellation
8.1 Cancellation by the guest A booking becomes binding once the guest's payment has been received. A binding booking may only be cancelled in accordance with the cancellation terms shown for the rate booked, quoting the booking ID. The specific cancellation deadlines and conditions follow from the rate the guest selects during booking. They are shown transparently during the booking process and in the booking confirmation, and are decisive for the contract. ALPAMI reserves the right to offer rates with differing cancellation terms (for example non-refundable, partly refundable or flexible rates), to introduce new rates and to adjust or discontinue existing ones. For bookings already concluded, the cancellation terms of the chosen rate as agreed at the time of conclusion always apply. Cancellation terms may vary by location, period, room type and season. Only the terms shown at the time of booking and stated in the booking confirmation apply. Once the cancellation deadline for the relevant rate has passed, cancellation is excluded and ALPAMI retains the claim to the agreed remuneration less any expenses saved. The same applies if the guest does not arrive (no-show). For guaranteed multi-night bookings, all subsequent nights are cancelled from the first night onwards if the guest does not arrive, and the guest has no further claim to them. Bookings for which the guest has not yet paid remain valid until 12:00 on the day of arrival. After 12:00 the reservation lapses automatically and free of charge, and ALPAMI may let the room to someone else. Regardless of the rate chosen, the following principles apply: – The arrival time is 15:00 on the booked day of arrival. – Cancellations must be made in text form quoting the booking ID. What matters for the deadline is when the cancellation reaches ALPAMI. – In the event of early departure after check-in, no refund is made for the remaining booked services. – Any partial refund outside the applicable cancellation terms is made as a gesture of goodwill only and is at ALPAMI's sole discretion. 8.2 Cancellation by ALPAMI If an agreed or requested advance payment or security is not provided even after a reasonable grace period set by ALPAMI has expired, ALPAMI is entitled to withdraw from the contract. ALPAMI is further entitled to withdraw for objectively justified reasons, for example where force majeure or other circumstances beyond ALPAMI's control make performance impossible; where rooms are booked on the basis of misleading or false statements of material facts; where ALPAMI has reasonable grounds to believe that use of the rooms may endanger the peace of the house, safety, or ALPAMI's public reputation; or where the guest breaches material obligations under this contract or the house rules. ALPAMI must inform the guest of the exercise of the right of withdrawal or termination without delay and in writing. Where ALPAMI withdraws with justification, the guest has no claim to damages.
9 Technical equipment and internet use
The guest uses their own electronic devices on the room's power supply at their own risk. Any faults or damage to the room's technical installations caused by such devices are borne by the guest, unless ALPAMI is responsible for them. The guest is prohibited from using the internet connection provided by ALPAMI for illegal file sharing, meaning any upload or download of copyright-protected material in any form. The guest is liable for all damage incurred by ALPAMI and/or the rights holder as a result. ALPAMI is entitled to collect any resulting costs directly from the guest's payment method on file. The guest may not pass on internet access credentials to third parties. In the event of a breach, the guest is liable to ALPAMI for all resulting damage. ALPAMI further reserves the right to block the guest's internet access without notice in the event of legal violations.
10 Access to the rooms
ALPAMI is entitled to enter the rented room for cleaning and linen changes, and — by arrangement with the guest — to carry out repairs, read electricity and water meters, perform safety checks and show the room to prospective subsequent guests. ALPAMI will inform the guest of planned access times in a reasonable manner. In cases of imminent danger, or where there is reasonable suspicion of a breach of these terms or the house rules, ALPAMI may also enter the room without arrangement with the guest. In such cases ALPAMI may involve third parties (for example specialist staff or authorities).
11 Upkeep and liability of the guest
The guest must treat the room, its contents and shared facilities with care, prevent damage, and ensure adequate ventilation and heating. In particular the guest must avoid excessive soiling, dispose of waste properly and regularly, and maintain a minimum level of order so that the agreed cleaning can be carried out without difficulty and the room kept clean and hygienic by standard cleaning measures. ALPAMI is entitled to charge the guest for additional cleaning required due to significantly excessive soiling or disorder. The minimum fee for additional cleaning is €80.00. For particularly serious soiling (for example from smoking, pets or substances) the cleaning charge is at least €250.00, plus all costs actually incurred. If the guest fails to meet these obligations even after a written warning, ALPAMI is entitled to terminate the accommodation contract without notice. The guest is liable for all damage to the building or contents caused by visitors, staff or other third parties from the guest's sphere, or by the guest personally. The guest is further liable for any other damage and expenses for which they are responsible and which arise for ALPAMI from improper use of the rented property or of items brought in. This includes costs incurred by ALPAMI through the negligent triggering of fire alarm systems (smoke detectors), in particular the cost of a chargeable fire brigade call-out. ALPAMI is entitled to collect all such costs from the guest's payment method on file without separate notice. The cost of remedying culpably caused damage is determined by obtaining a quotation from a specialist trade business. Pending that quotation, ALPAMI may collect a reasonable advance from the payment method on file. The guest must do what can reasonably be expected to remedy the disruption and keep any damage to a minimum.
12 Liability of ALPAMI
ALPAMI is liable for damage for which it is responsible arising from injury to life, body or health, and for other damage based on an intentional or grossly negligent breach of duty by ALPAMI, or on an intentional or negligent breach of duties typical of the contract. A breach by a legal representative or vicarious agent is equivalent to a breach by ALPAMI. Further claims for damages are excluded unless otherwise provided. ALPAMI is liable for items brought in according to statutory provisions. If the guest wishes to bring in money, securities or valuables worth more than €500.00, or other items worth more than €3,500.00, a separate safekeeping agreement with ALPAMI is required. Where a parking space is provided to the guest, whether for a fee or not, no safekeeping contract arises and ALPAMI has no duty of supervision. In the event of loss of or damage to motor vehicles parked or manoeuvred on the property, or their contents, ALPAMI is liable only for intent or gross negligence. The guest must report damage without delay, and obvious damage at the latest before leaving the parking facility. ALPAMI is not liable for damage caused solely by other tenants or third parties. Messages, post and deliveries for guests are handled with care, but ALPAMI accepts no liability for them. ALPAMI handles delivery, storage and — on request and for a fee — forwarding. No safekeeping contract arises from this. ALPAMI accepts no liability for lost property, except liability arising from intentional or grossly negligent breaches of duty. Lost property is returned only on request, against postage costs in the corresponding amount (depending on the destination) and a handling fee of €15.00. ALPAMI undertakes to store lost property for six months.
13 Final provisions and house rules
The language of the contract is German; an English translation of these terms is also available. In the event of contradictions between the language versions, the German version applies. These terms also include compliance with the house rules, which are available in their current version via ALPAMI's website. Amendments or additions to the contract, to the acceptance of the application, or to these terms for renting rooms should be made in writing. Unilateral amendments or additions by the guest are invalid. The place of performance and payment is the registered office of the accommodation business. Where the guest is a merchant, the exclusive place of jurisdiction — including for cheque and bill-of-exchange disputes — is the registered office of ALPAMI Group GmbH. Where a contracting party meets the requirements of section 38(2) of the German Code of Civil Procedure and has no general place of jurisdiction in Germany, ALPAMI's registered office applies. German law applies. The application of the UN Convention on Contracts for the International Sale of Goods and of conflict-of-law rules is excluded. Should individual provisions of these terms and/or of the rental contract be or become invalid, the validity of the remaining provisions is unaffected. In that case the statutory provisions apply.
